Dutch music dates back to as early as 1958 when a 14 year old violinist Dick Bor performed a solo in the Dutch youth Ochestra during a concert at the Kurhaus Scheveningen. The concert was held during the Holland Festival which is an annual event held in Amsterdam and is a platform for the dutch performing arts as well as the international arts.
The Dutch Youth Orchestra has been a breeding ground for the arts alongside such establishments as the Royal Concertgebouw Orchestra which was established in 1888.These institutions have both been a great contribution to Dutch music as well as the growth of many talented musicians. The RCO is world renowned and many from the international performing arts industry are always honored to work with it.
This teamwork between different artists not only goes to inspire the Dutch performing arts but also brought about the realization of their importance to the government. This led to the creation of the Raad Voor Cultuur which is the arts council so as to advise the government on management of the arts.
This council was established in 1956 in the Hague by the minister for Education, Arts and Science. The council board is made up of well respected people from the different sectors of the Dutch performing arts. For instance, the Dutch theatre is headed by Sonia Gaskell a renowned ballet dancer.
The performing arts are well sponsored by the government as well through the cultural office in the Dutch embassy. This office is responsible for the exchange of information with other performance arts missions in countries like the United States. Their biggest tasks is to implement Dutch national and international cultural policy in the United States.
The cultural office informs American cultural professionals such as curators, publishers and journalists about the arts and artists in the Netherlands. The cultural office also facilitates a smooth transition for Dutch performing artists by advising them on how they can get funding for their work. The office also represents the Dutch government in performing arts events like festivals and conferences.
However, the cultural office makes a clear distinction between what it does and does not do Although they are very much in support of the Dutch performing arts, they do not promote individual artists or companies .The office does not also book any performances for Dutch music or theatre. Nevertheless, they do offer advisory services to ensure that performing arts events are organized by the right people and that they get proper funding.
Dutch performing arts enjoy a favorable atmosphere in the United States and this has led to such sectors as the dance and Dutch theatre receiving funding and recognition. Transfer pricing revenue to rise Rs.3,000 cr in 2013-14
With the Finance Act bringing domestic transactions under the transfer pricing scanner, income tax revenue is expected to rise by Rs.3,000 crore in 201314, said tax authorities.
?We will start looking at domestic deals for the first time this financial year. We expect 50 per cent of domestic companies to be affected by this, increasing the revenue of the income tax department by Rs.3,000 crore,? said a Mumbai based senior income tax official.
Transfer pricing adjustments in 2007-08 stood at about Rs.1,600 crore, increasing to Rs.44,500 crore in 2011-12.
Earlier, transfer pricing was applicable on companies with cross-border operations. However, from this financial year, the finance minister has brought domestic firms and transactions into the net.
Transfer pricing is a principle based on which goods and services are priced.
In this process, open market rates are considered benchmarks for transactions between group companies across borders.
The move would impact companies that operate units in special economic zones (SEZs) and park the majority of their profits in these to avail the tax incentives applicable.
Real estate firms, which route transactions through hundreds of subsidiaries and associate companies, would also need to comply with the transfer pricing documentation and reporting norms.
Rohan K Phatarphekar, partner and national head (global transfer pricing services), KPMG, said, ?The extending of transfer pricing provisions to specified domestic transactions will result in additional compliance burden on taxpayers and, in some cases, may actually be more onerous than cross-border transfer pricing. Given the enormous litigation in the transfer pricing space, taxpayers expect a similar fate in the assessments of specified domestic transactions in the future.? The latest amendments have extended the concept of arm?s length pricing to these transactions.
The move was in line with a Supreme Court recommendation in the CIT-versus-Glaxo SmithKline Asia case, the Finance Bill said.
The Bill has amended the definition of international transactions and has been extended to include ?specified domestic transactions? of Rs.5 crore and more.
Certain expenses, transfer of goods and services between related parties, extraordinary profits and profits earned by special economic zones would now be liable for scrutiny by transfer pricing officers.
The penalty for not complying has been made stringent, from Rs.1 lakh, irrespective of the size of to transaction, to two per cent of the deal.
NC Hegde, partner, Deloitte Hask-ins and Sells, said, ?Many more dome-stic transactions will now come under the tax scanner." He added transfer pricing was now sector-agnostic in nature.

MOSCOW (AP) ? Russian tycoon Mikhail Fridman on Monday unexpectedly announced his resignation as chief executive of TNK-BP, the Russian venture of British oil company BP.
TNK-BP said in a statement that Fridman has submitted a letter of resignation as CEO and chairman of the management board and is due to step down in 30 days. It did not specify the reason, but BP's representative in Russia, Vladimir Buyanov, said Fridman left the compnay for "personal reasons."
Fridman is considered one of the most influential people in the venture, which he was to head throughout 2013.
TNK-BP, which is owned in equal parts by BP and a group of Russian billionaire shareholders known as AAR, has been plagued by shareholder conflicts much of the time since it was formed in 2003.
The company said it will be run by "a group of executives who hold powers of attorney related to their areas of responsibility" before a replacement is found for Fridman. BP sought to play down the importance of Fridman's resignation, saying he was not involved in running the company on a day-to-day basis.
BP has pledged to work with AAR to appoint a replacement "as soon as reasonably possible," said Buyanov.
AAR was not immediately available for comment.
A multi-billion deal with Russian state-owned firm Rosneft to tap for oil in the Artic broke down last year after AAR blocked it, claiming BP should be pursuing such a deal through TNK-BP.
TNK-BP's shares on Moscow's MICEX stock exchange dipped immediately after the announcement but recovered half an hour afterward to hover 1 percent higher than Friday's close, in line with the market.
The Health Ministry is looking into adding two new diseases to the list of illnesses for which early detection tests are done on infants.
The new diseases that a special ministry committee is considering adding are cystic fibrosis and SCID (severe combined immunodeficiency).
A new ministry report reveals that in recent years, about 130 babies a year have been diagnosed with serious diseases. This number has increased since 2009, in part because hospitals now test for more diseases than before in the blood tests taken shortly after birth.
There also has been an increase in diagnoses of hypothyroidism ? which isn?t life-threatening, but which can cause developmental delays if not treated promptly. In 2009, 59 babies were diagnosed with the disease. But the figure rose to 96 in 2010 and 113 in 2011, an increase of 91 percent in two years.
Prof. Joel Zlotogora, head of the Health Ministry?s community genetics department, said other Western countries are also experiencing a rise in genetic disease, ?and the reason isn?t clear.? America?s Center for Disease Control, for instance, has recorded a 30.4 percent increase in hypothyroidism over the last decade.
Altogether, 506,759 babies were born in Israel in 2009-2011. Of these, aside from the hypothyroid babies, 117 were diagnosed with some other kind of metabolic disease. These included 21 with phenylketonuria, which can cause developmental delays if untreated, and 11 with MCAD, which causes sudden death in about one-third of the babies who have it.
To diagnose such diseases, blood samples are taken from all babies 48 to 72 hours after birth, except in a few cases where the parents refuse (there were 170 such cases in 2011 ). Babies that test positive for certain diseases are then sent for further testing, since blood tests sometimes produce false positives.
Different countries test for different genetic diseases. Since 2009, Israel has tested for 11 diseases. That is more than Britain (7 ), France (5 ) or Switzerland (3 ), but less than Denmark and Germany (15 ), Holland (20 ), Hungary and Portugal (25 ) or the United States (29 ).
Now, however, a special Health Ministry committee is considering adding cystic fibrosis and SCID to Israel?s list. Cystic fibrosis, which currently afflicts some 500 Israelis, can be ameliorated by early treatment. SCID, a disease found in one out of every 100,000 children, can, if diagnosed early, be treated by a bone marrow transplant before serious infections have time to develop.
If the committee decides to add these tests, the ministry will ask the so-called ?health basket committee,? which approves the addition of new treatments to the national health insurance program, to authorize funding for the new tests next year.

Vasi, who's also Latina, spoke exclusively to The Huffington Post about her new 'Single Ladies" character, told us what it's like replacing Dash for the show's second season, and told us what it was like to make out with Cuban telenovela hunk, William Levy, who plays her character's love interest on the show!
Tell us about your character, Raquel! Raquel?s relationship with Keisa (LisaRaye McCoy) is long-standing. They?ve been best friends forever. We just didn?t see Raquel on the first season because her busy career had her traveling, and when we meet Raquel in episode one, it's supposed to be the happiest day of her life and it turns out to be the worst day. But it?s one of those things where something bad happens, but something greater comes out of it. And, it propels Raquel into this journey and that?s what the whole season is basically about for her?rediscovering who she is and what she wants.
What do you love most about playing Raquel? She doesn?t have to throw any of her physical-ness in front of anyone, because there are so many things about her outside of that that are attractive, that you just kind of fall in love with the character. It has been super fun to keep discovering who she is.
Does Raquel know Val (Stacey Dash)? We didn?t really get into that in the writing. I mean, you?ll quickly understand where Val is and that she?s not coming back. And, we don?t really discuss the fact of Raquel and Val having or not having a relationship. But because my job as an actor is to make these kinds of decisions?because she was one of Keisha?s best frineds and I have been one of Keisha?s best friends?I think they obviously know each other.
Is it a lot of pressure coming onto a show in its second season? The fact that I wasn?t recast to play the same character?I think things would have been different had that been the situation. But as an actor, it?s kind of a relief when you come on a show that you already know is a success.They have a built-in audience and the show is written in a certain way that the fans will keep coming back regardless. No one likes change, so I think at first everyone was very doubtful or super critical, but I hope that they?re going to fall in love with Raquel the same way I have fallen in love with playing her.
We know William Levy plays your love interest on "Single Ladies." What was it like making out with him? It was exactly everything that you imagine. I heard William was cast and obviously I knew who he was?I know now everyone in America knows who he is?but I knew who he was because I called my grandmother and my grandmother was like, ?ay dios mio, William!? We knew him from the telenovelas.
Do you think people will enjoy their relationship?
I think so. It's really sweet. His character Antonio was my character Raquel's first love and first sexual partner?she lost her virginity to him?so there?s something really sweet about them reconnecting. But you know, the minute they do it's very sexy and hot {Laughs}.
A lot of people may not know this about you, but in addition to being Greek, you?re also Puerto Rican and Dominican. Do people know you?re Latina when they meet you? If they know who I am...I?ve always been pretty vocal in talking about my culture, because as you can imagine, coming with that kind of background, it?s really important to be prond of where you?re from. I think initially people?I get a lot of ?are you Portugese or Brazilian?? I think people don?t know exactly where I?m from. I am Puerto Rican, Dominican, Greek from Brooklyn! {Laughs}.

VATICAN CITY (AP) ? The Vatican's inquisition into the source of leaked documents has yielded its first target with the arrest of the pope's butler, but the investigation is continuing into a scandal that has embarrassed the Holy See by revealing evidence of internal power struggles, intrigue and corruption in the highest levels of the Catholic Church governance.
The detention of butler Paolo Gabriele, one of the few members of the papal household, capped one of the most convulsive weeks in recent Vatican history and threw the Holy See into chaos as it enters a critical phase in its efforts to show the world it's serious about complying with international norms on financial transparency.
The tumult began with the publication last weekend of a book of leaked Vatican documents including correspondence, notes and memos to the pope and his private secretary. It peaked with the inglorious ouster on Thursday of the president of the Vatican bank. And it concluded with confirmation Saturday that Pope Benedict XVI's own butler was the alleged mole feeding documents to Italian journalists in an apparent bid to discredit the pontiff's No. 2.
"If you wrote this in fiction you wouldn't believe it," said Carl Anderson, a member of the board of the Vatican bank which contributed to the whirlwind with its no-confidence vote in its president, Ettore Gotti Tedeschi. "No editor would let you put it in a novel."
The bank, known as the Institute for Religious Works, issued a scathing denunciation of Gotti Tedeschi in a memorandum obtained Saturday by The Associated Press. In it the bank, or IOR by its Italian initials, explained its reasons for ousting Gotti Tedeschi: he routinely missed board meetings, failed to do his job, failed to defend the bank, polarized its personnel and displayed "progressively erratic personal behavior."
Gotti Tedeschi was also accused by the board of leaking documents himself: The IOR memorandum said he "failed to provide any formal explanation for the dissemination of documents last known" to be in his possession.
In an interview with the AP, Anderson said the latter accusation was independent of the broader "Vatileaks" scandal that has rocked the Vatican for months. But he stressed: "It is not an insignificant issue."
Gotti Tedeschi hasn't commented publicly about his ouster or the reasons behind it, saying he has too much admiration for the pope to do so. He also hasn't been arrested, avoiding the fate that befell Gabriele.
The 46-year-old father of three has been in Vatican detention since Wednesday after Vatican investigators discovered Holy See documents in his apartment. The Vatican spokesman, the Rev. Federico Lombardi, said Gabriele had met with his lawyers and that the investigation was taking its course through the Vatican's judicial system.
Gabriele, the pope's personal butler since 2006, has often been seen by Benedict's side in public, riding in the front seat of the pope's open-air jeep during Wednesday general audiences or shielding the pontiff from the rain. In private, he is a member of the small papal household that also includes the pontiff's private secretaries and four consecrated women who care for the papal apartment.
Lombardi said Gabriele's detention marked a sad development for all Vatican staff. "Everyone knows him in the Vatican, and there's certainly surprise and pain, and great affection for his beloved family," the spokesman said.
The "Vatileaks" scandal has seriously embarrassed the Vatican at a time when it is trying to show the world financial community that it has turned a page and shed its reputation as a scandal plagued tax haven.
Vatican documents leaked to the media in recent months have undermined that effort, alleging corruption in Vatican finance as well as internal bickering over the Holy See's efforts to comply with international norms to fight money laundering and terror financing.
The Vatican in July will learn if it has complied with the financial transparency criteria of a Council of Europe committee, Moneyval ? a key step in its efforts to get on the so-called "white list" of countries that share financial information to fight tax evasion.
Anderson acknowleged that the events of the last week certainly haven't cast the Holy See in the best light. And he said the bank's board appreciated that the ouster of its president just weeks before the expected Moneyval decision could give the committee pause.
"The board considered that concern and decided that all things considered it was best to take the action at this time," Anderson said. "These steps were taken to increase the IOR's position vis-a-vis Moneyval."
The Vatileaks scandal began in January when Italian journalist Gianluigi Nuzzi broadcast letters from the former No. 2 Vatican administrator to the pope in which he begged not to be transferred for having exposed alleged corruption that cost the Holy See millions of euros in higher contract prices. The prelate, Monsignor Carlo Maria Vigano, is now the Vatican's U.S. ambassador.
Nuzzi, author of "Vatican SpA," a 2009 volume laying out shady dealings of the Vatican bank based on leaked documents, last weekend published "His Holiness," which presented a trove of other documents including personal correspondence to the pope and his secretary ? many of them painting Benedict?s No. 2, Cardinal Tarcisio Bertone, in a negative light.
Nuzzi has said he was offered the documents by multiple Vatican sources and insisted he didn't pay a cent ? to any of them.
Gabriele was in Vatican custody and unavailable for comment. No known motive has come to light as to why Gabriele, if he is found to be the key mole, might have passed on the documents. Nuzzi declined to comment Saturday on whether Gabriele was among his sources.
Bertone, 77, has been blamed for a series of gaffes and management problems that have plagued Benedict's papacy and, according to the leaked documents, generated a not inconsiderable amount of ill will directed at him from other Vatican officials.
"For some time and in various parts of the church, criticism even by the faithful has been growing about the lack of coordination and confusion that reign at its center," Cardinal Paolo Sardi, the former No. 2 official in the Vatican secretariat of state, wrote to the pope in 2009, according to the letter cited in "His Holiness."
Anderson, who heads the Knights of Columbus, a major U.S. lay Catholic organization, said he was certain the Holy See would weather the storm and that the Vatican bank, at least, could move forward under a new leader with solid banking credentials as well as a desire to show off the bank's transparency.
"I hope this will be the beginning of a new chapter for the IOR and part of that chapter will be restoring the public image of the IOR," he told AP. "I think we have a good story to tell."

As news spread of the recent wedding of?Mark Zuckerberg, the Facebook billionaire, and Priscilla Chan, the recently graduated medical student, one aspect of their courtship has drawn scrutiny from the chatterati. Such agreements are hardly common. But many couples do make contracts, written or oral, delineating the idiosyncratic needs of their relationship: how much time they need to spend together and apart; who cooks and who cleans; who feeds the fish. Some turn to couples? counselors, some hammer out such agreements themselves (as did Ms. Chan and Mr. Zuckerberg, apparently), and others even resort to lawyers. Such discussions expose a couple?s vulnerabilities, and make clear how each partner wants to be heard and understood.
?Each party has a chance to draw a line in the sand or negotiate,? said Kelly M. Roberts, a marriage and family therapist in Oklahoma City. ?It?s not based on economic earnings but on relationship capital.?
These are different from prenuptial agreements, which are used to protect marital assets in case of death or divorce. By contrast, relationship agreements can read like wish lists: a business plan for a successful romance. And unlike prenups, which have been challenged in court, most lawyers think that such agreements generally are legally unenforceable.
?It?s more about acknowledging the seriousness of the discussion,? said Cheryl Lynn Hepfer, a matrimonial lawyer in Bethesda, Md. ?People?s memories fail. So they say, ?Remember when this was so important to us that we signed, with witnesses????
Lawyers say these contracts are a stripped-down version of cohabitation agreements, which gay men and lesbians in particular began writing years ago when states prohibitedsame-sex marriage. Those agreements, which protected finances, often enumerated relational requirements.
Ken Altshuler, a lawyer from Portland, Me., who is president of the American Academy of Matrimonial Lawyers, said that in one cohabitation agreement he drafted, a partner prone to seasickness allowed his partner to take one cruise-ship vacation a year, alone.
In return, the seasick-prone partner could not ?berate or complain? about cruises, including such digs as blasting the theme from ?The Love Boat.?
Cohabitation agreements are now also used by heterosexual couples who may not envision marriage. An agreement might stipulate, for example, that if one partner sets aside graduate studies to work to support the other while finishing up school, then eventually they must reverse roles.
?The issues haven?t changed, but how we?re framing them has,? said Paul Hokemeyer, a Manhattan therapist. ?Women are saying: ?I have a place in the world. I won?t just wait around and expect you to be kind and generous. Let?s nail this down.???
Even just documenting the emotional quid pro quos of a relationship has value, couples? therapists said. The process forces people to confront issues that might otherwise fester.
Relationship agreements also have contemporary currency because they can be used to ?dtr,? texting shorthand for ?define the relationship.? And once a couple has worked out their latest terms to ?dtr,? they can post a status update on Facebook.
BAGHDAD (AP) ? Iraq's president on Saturday urged the nation's bickering factions to resolve the bitter political dispute that has gripped the government for nearly six months, warning that the crisis threatens to split the country.
President Jalal Talabani's statement, posted on his website, is the latest plea for an end to the crisis that has engulfed Iraq since Shiite Prime Minister Nouri al-Maliki's government issued an arrest warrant for the country's Sunni vice president in December ? just as the last U.S. troops left the country.
Shiite, Sunni and Kurdish politicians have been holding meetings for weeks to discuss how to resolve the deadlock, including whether to try to push al-Maliki to step down before the end of his four-year term in 2014. Al-Maliki's critics accuse him of consolidating power and sidelining both Sunnis and Kurds, touching off a political impasse that has brought government work to a near standstill.
Already, the president of Iraq's northern self-rule Kurdish region has said he will hold a popular referendum on whether to secede if the deadlock is not solved by local elections set for September.
"I am firmly convinced of the seriousness of the current circumstances which require that we speed up efforts to sit at the table of constructive and fraternal dialogue," said Talabani, a Kurd, whose post is largely ceremonial.
Otherwise, he said, the crisis "could lead to growing tensions and exacerbate the risks and problems."
Talabani in the past has played the role of a mediator in Iraq's frequent political disputes.
The political threat to al-Maliki has shifted over several months, and it's not clear whether parliament will force the vote to oust him. The prime minister on Saturday issued his own plea for talks, saying "dialogue and clarity is what can bring good."

Findings suggest cancer cells may grow more easily than researchers and clinicians have hoped
Chromosomal deletions in DNA often involve just one of two gene copies inherited from either parent. But scientists haven't known how a deletion in one gene from one parent, called a "hemizygous" deletion, can contribute to cancer.
A research team led by Stephen Elledge, a professor in the Department of Genetics at Harvard Medical School, and his post-doctoral fellow Nicole Solimini, has now provided an answer. The most common hemizygous deletions in cancer, their research shows, involve a variety of tumor suppressing genes called STOP genes (suppressors of tumorigenesis and proliferation) that scatter randomly throughout the genome, but that sometimes cluster in the same place on a chromosome. And these clusters, said Elledge, who is also a professor of medicine at Brigham and Women's Hospital, tend to be deleted as a group. "Eliminating the cluster gives a bigger bang for the deletion buck," he said.
This finding is especially interesting in light of the two-hit model of cancer formation, which holds that both copies of a recessive gene need to be inactivated to trigger a biological effect. Thus the loss of a single tumor suppressor copy should have little or no influence on tumor cell proliferation because the remaining copy located on the other chromosome is there to pick up the slack.
Elledge's research points to a different hypothesis, namely that STOP genes in a hemizygous deletion aren't recessive but are instead haploinsufficient, meaning that they depend on two copies to function normally. "If a tumor suppressor is haploinsufficient, then a single gene copy lacks the potency needed to fully restrain tumorigenesis," Elledge explained, who is also a Howard Hughes Medical Institute Investigator. "So by removing clusters of haploinsufficient genes all at once, the cancer cell immediately propels its growth forward without having to wait for the other copies to also be lost."
Angelika Amon, a professor of biology at the Massachusetts of Technology, said she's surprised by the findings. "We've known from a lot of human syndromes that haploinsufficiency is widespread in the development of complex multicellular organisms," she said. "But these data show it's also critical for individual cells and cell proliferation."
The results also offer a different take on the two-hit model in carcinogenesis, Amon said. Being remarkably unstable, cancer cells can delete gene copies at every turn of the corner. If the loss of a single tumor suppressor copy provides no survival advantage for the tumor, then the tumor has no incentive to retain the cell with that deletion. But if the loss of that copy boosts proliferation, then the probability of a second hit later is greatly increased. "So haploinsufficiency is a way for the cancer cell to dramatically accelerate the acquisition of growth beneficial mutations," Amon said.
In other words, all it takes is a 50 percent reduction in gene activity for a cancer cell to grow. "That tells us it's a lot easier to get cancer than we might have hoped," Amon said.
According to Elledge, the number of hemizygotic deletions averages roughly six per tumor, with some tumorsbreast and pancreatic, for instanceaveraging up to ten. Each deletion involves 25 to 40 genes, many of them STOP genes, but also a few GO genes (growth enhancers and oncogenes) that enhance proliferation. That the STOP genes substantially outnumber their GO counterparts is important, Elledge explained, because it means cancer cells can tilt scales toward proliferation without also compromising it at the same time.
"The data reveal a lot of haploinsufficient players that have small effects individually, but large effects in combination," Elledge said. "Unfortunately, it's not easy to see how to take advantage of that chemotherapeutically."
What's important about the results, he emphasized, is that they open up new views on how tumors evolve. Moreso, they underscore the importance of proliferation as a fundamental feature of tumor growth, he added.
The challenge now, Elledge said, will be to find out which of the genes in a recurring deletion are haploinsufficient. "At the moment, we estimate roughly 25 percent," he said. "So these findings could also have important ramifications for other human diseases in addition to cancer."

Similarly, Dr. Gerry Chodak has now offered?an updated ?consent form? that could be given in advance to men considering or potentially considering whether being tested for risk of prostate cancer is appropriate for them as an individual. The data used in this consent form are based on the data presented by the USPSTF, and so some readers may not be entirely comfortable with those data, but the idea behind this consent form is very certainly a reasonable one because it is primarily designed to expand the knowledge of the candidate for testing before he starts down what we all acknowledge to be a potentially ?slippery slope? for an otherwise uninformed patient. Dr. Chodak also discusses his thinking behind this consent form on one of his Medscape video blogs.
In thinking about all of these issues, it is important to appreciate the critical difference between the ideas behind ?screening? (of all men of a certain age on a specific and regular basis) and ?testing? (of specific individuals who wish to be so tested). The ?New? Prostate Cancer InfoLink and Prostate Cancer International have long believed that there are few (if any) data to justify the annual, mass, population-based screening of all men (over 50 or any other age) for risk of prostate cancer. On the other hand, we also believe that there are strong reasons for men to establish a baseline PSA in their late 30s or early 40s and then, depending on their known risk factors, to discuss the appropriate future frequency and value of PSA tests and DREs for them, as individuals, with their doctors, with a full appreciation of the facts associated with actual diagnosis and treatment of localized prostate cancer.
We are in complete and utter agreement with the USPSTF on one fact and one fact only. Until we have better tests to assess the risk for and diagnose clinically significant (as opposed to indolent) prostate cancer, we are never going to be able to completely resolve the issue of who should or should not actually receive immediate treatment for localized disease. Until we have such tests, active surveillance is a form of management that is highly appropriate as a first-line strategy for somewhere between 30 and 50 percent of all men newly diagnosed with localized prostate cancer, most especially among the subset of men with a limited life expectancy (based on their age at diagnosis and other factors that are likely to impact their overall mortality).

A foreclosure in Florida begins when a lender files court action and records a notice of a pending lawsuit (Lis Pendens) against the borrower. The lender notifies the borrower and any other affected parties in person (or in some cases by mail or publication). If the borrower does not respond to the court action within a specified amount of time, the county clerk can find the borrower in default and the lender can ask the court to make a final ruling. Condo & HOA Law: The Lien and Foreclosure Process in Florida
The association is required to give notice to the homeowner prior to filing the lien by sending two copies of the notice, one by regular mail and one by certified mail, that includes the amount due and the deadline for payment. For HOAs this is 45 days and for condos this is 30 days. If you missed payments, the lien will include the assessments, interest, attorneys fees, and if the governing documents allow, late fees. Once you are turned over to an attorney for collections any payments are applied to all the fees first and assessments last.? After the lien is recorded the association must then go through the same process to foreclose before filing to foreclose on your home. Once you receive a summons, you have 20 days to file an answer and affirmative defenses or a motion to dismiss. The association will file a motion for summary judgment, which means there are no disputed facts and the association should get your home without a trial.? DO NOT ATTEMPT TO HANDLE THIS WITHOUT AN ATTORNEY.?Your best option is to negotiate a payment plan or file Chapter 13 bankruptcy to put this in a 5-year payment plan. Chapter 7 will not save the home.? If you missed any payments, fighting over the amount with the association is useless in almost all instances because it will generate attorneys fees that you are liable for and must be paid to keep your home. The courts will award the attorneys 100% of their attorneys fees if you are at fault, even if it?s a small amount and their numbers are wrong.? The courts are facing having their funding cut thanks to the foreclosure cases clogging up the dockets. In many cases good case law is being ignored to move the cases out of the courts and owners are being denied justice and due process because of budget concerns. TALLAHASSEE, Fla. ? May 10, 2012 ? The greater Miami area led the nation in the percentage of homeowners that went through a foreclosure or who were more than 90 days behind on their mortgage payment, according to a national review of 366 metropolitan areas released yesterday by Foreclosure-Response.org, a Washington-based advocacy group maintained by the Center for Housing Policy, the Local Initiatives Support Corporation and the Urban Institute. Florida has been slow to get back on its feet because of a foreclosure process that, on average, takes more than two years to complete, according to the report. Miami-Dade/Fort Lauderdale/Pompano Beach had the nation?s highest foreclosure rate and the highest percentage of delinquent loans in December. The Miami metropolitan area had a foreclosure rate of 18.9 percent. Add to that the percentage of mortgages more than 90 days late and the figure jumps to 23.6 percent ? nearly one in four mortgages. Florida cities captured nine out of the top 10 slots on both foreclosures and delinquencies for the month. Looking at just foreclosures, Florida held the top five spots, with Miami followed by Port St. Lucie (16.7 percent), Palm Coast (16.6 percent), Tampa (15.9 percent) and Orlando (15.6 percent.) ?The high and growing foreclosure rate reflects a buildup of homes that are stalled in the foreclosure process,? the report stated. ?According to data from LPS Applied Analytics, foreclosure starts continue to outpace foreclosure sales, and the foreclosure rate will remain high until these properties fully complete the foreclosure process.? Lenders who halted foreclosure proceedings amid the robo-signing investigations are now resuming their efforts to get rid of troubled properties. Like other large cities, Florida?s metropolitan areas have seen a steady uptick in foreclosures over the past few years. Another major factor contributing to the backlog in Florida is that a judge must be involved in foreclosure proceedings, a requirement that has slowed the foreclosure process in Florida and other states that require judicial review. In Florida, the average foreclosure takes more than 800 days to complete. Recent attempts to remove judges from the equation have not garnered the legislative support needed to pass. ?This year Florida re-hired retired judges to help sort through the backlog of foreclosures,? the group concluded. ?However, the future still remains unclear in Florida and other judicial states.? Key Case in Florida Supreme Court Could Strike a Blow Against Bank?s Fraudulent Foreclosure Practices
The Florida Supreme Court heard oral arguments in an important case that could have wide-ranging implications for foreclosures in that state. The case, Roman Pino v. Bank of New York Mellon, could invalidate the ability of banks to refile documents in situations where the initial documents they filed to foreclose on homeowners were fraudulent. Pino went through a foreclosure on his house in 2008, but attorneys found that the mortgage assignment used in the foreclosure proceedings was signed by known robo-signer Cheryl Samons and stamped with a notarization that was out of date. In depositions, Samons and colleagues at the David J.
